Inteirm EAD needed.

Ok here's my situation first off.

I was an F-1 student when I applied for my Optional Practical Training (OPT) back in May 1, 2006. I got a Receipt for it on May 3, 2006.
July 19, 2006 I received for Request for Evidence (RFE) for National Special Entry Exit Registration System (NSEERS). I sent in July 20, 2006 and got an update on my Case on July 21, 2006 on the Case Status USCIS site.

Today it has been more than 90 days since my Initial Receipt date. How do I get an Interim Employment Authorization Document (iEAD)?

I have already tried walking in to the Dallas Service Center without an Infopass appointment and the guy at the window told me that they don't do that here since they don’t handle OPT request here.

I'm really desperate here because a company is already willing to hire me and they have waited for 2 weeks for my EAD to come.

I know that the Infopass system is issuing appointments for Interim EAD's because I just got one.

My questions are:

Was the guy wrong about the Dallas service center not giving iEAD cards?
Should I try it again with an Infopass appointment?
Why is life so hard?
Does anyone have any experience with this?
 
when you made your info pass appointment, what category did you select? Make sure to make an appointment for IEAD , not just a general appointment to speak to an immigration officer. The reason is that your case will be assigned to immigration officer based on the type of appointment. If you make an appointment and select that 90 days have passed since you applied. I am sure they will give you an IEAD.
 
So, we need to click on........90 days have passed (Today is 76th day, RD May 26) or option 1? I am applying 14 days ahead of time. Please let me know.

Also, right now I am in other state. So, Do i need to go back to the Dallas office where my case was filed or can I take appointment at an office here in different state?

The Results of my Appontment

Well it's not good news.

Since I dont have an alien number since I was a student that doesn't get a alien number, I cannot recieve a tempory EAD. I just have to wait until it comes.

Hi,

Well...that is not true !! I don't know why they told you that because a couple of other people in "EAD card processing slowed............." thread have gotten their I-EADs without any problems. I-EAD is meant for every student only and if you are one then you should get I-EAD card. I would recommend talking to people in that thread and call their National customer care and get more details.

Interim EAD at Dallas DO and Houston DO

hi guys,

i had been to the Dallas DO for iEAD. They denied the request. they said that they donot process OPT - EADs (i.e., category - c 3 i ). After clearly explaining, that its an interim EAD request, showing letter from employer, letter from international councellor, and that 90 days has passed since i had applied for EAD and acc. to the USCIS website, am eligible for iEAD ( i even showed the USCIS issued public notice (july 28)) - they said they no longer take in interim/temporary OPT/EAD requests. there were otehr students in line with me - they were denied too.

I fixed an appt immediately with the houston DO (the houston DO check in officer was pissed that i got an infopass appt at houston when i belonged to the dallas jurisdiction but after an earful, he let me in to talk to the immigration officer but told me that they will not process my application here). but atleast, i got to talk to the immi officer.

the houston DO told me the same thing. they said a lot of f1 students are asking for iEAD as the process is taking long - but unfortunately, they no longer give temp EADs or interim EADs. I also met some students with May 1st RD in houston DO. they got the same answer.

When i told them (both dallas and houston do) that there are other district offices that are still issuing iEADs....they said they donot know anything about other DOs. but their DO will not issue iEAD.

I asked them what are students supposed to do? even after the 90 day period, it seems unfair that some students are getting iEADs while some are not. they asked me to mail a letter to the TSC (mesquite,tx) where i had initially filed the application and find out why its taking long.

I have faxed an expidite request to TSC from me (july 27th), a request from my international councellor(aug 2), a request from my employer (aug 9th). when i asked the DO about it, they said tht that i just have to wait.

on asking about the processing times on the website, and how come ppl with june dates are getting processed but dates in may are still left out - i was given a shrug and was asked to leave.

In texas, Dallas DO and Houston DO donot issue OPT - EADs or iEADs for sure.

i have no idea what am i supposed to do now. my empoyer has been holding my position since july. am exhausted, frustrated and feel totally helpless.
