I am looking for ways to reduce the delay introduced in my pending employment-based (EB2) I-485 application due to the 2 transfer notices received so far. I am in the very final stage (interview phase). The whole I-485 preliminary processing was completed on Oct xx, 2001. However, my I-485 file has been transferred again. The National Immigration Help Line informed me last week that it takes another 2 years to receive an interview. This is the delay I am interested in minimizing.
The I-485 receipt notice, which I received on Sep xx, 2000, indicates that processing usually takes 365-540 days only. In addition, both Transfer Notices indicate that it takes only several months to schedule and conduct an interview or take another action on my case. I found out this is not true because I have not yet received any decision on my I-485 case after I have exceeded the expected processing times shown on both the I-485 Receipt Notice and the original Transfer Notice.
The Vermont Service Center (VSC) is not supposed to send me another Transfer Notice because the I-485 preliminary processing was completed on Oct xx, 2001 plus I am now eligible to receive a decision on my I-485 application (I have exceeded the standard processing times).
The date of the transfer that’s indicated in the online case status report (as well as on the VSC Automated Voice System) is now December xx, 2002 (instead of October xx, 2001). The online case status report is as follows:
" On December xx, 2002, we transferred your I-485 application to adjust to permanent resident status to 26 Federal Plaza, NY to schedule and conduct your interview. Scheduling can take several months. That office will notify you when they schedule your interview or take other action on your case.”
The previous case status report was as follows:
" On October xx, 2001, we transferred your I-485 application to adjust to permanent resident status to 26 Federal Plaza, NY to schedule and conduct your interview. Scheduling can take several months. That office will notify you when they schedule your interview or take other action on your case.”
Notice that there is a contradiction here: It is not possible to have 2 transfers to 26 Federal Plaza to occur for the same file. The first Transfer Notice indicated that my I-485 file has already been transferred to 26 Federal Plaza; therefore, it is not possible to have it transferred again to 26 Federal Plaza when it has already moved to this address. (Please notice the 2 Transfer Notices above).
My I-485 application has exceeded the standard processing time (365-540 days) indicated on my I-485 receipt. (My I-485 receipt date is September xx, 2000).
Here, I seek your opinion on how to speed up my I-485 processing by minimizing the delay to only several months as indicated on the first transfer notice received in 2001 (above). I have well exceeded the standard processing time(s) and am now eligible to receive a final decision. Please advise what to do in case I receive a 3rd Transfer Notice by mistake.
