New York: A Hyderabadi software engineer in the US, who went to prison for no fault of his, was released after a harrowing 21 days when American immigration authorities realised they had goofed up.

Rayan Babu Yellina was detained in El Paso, Texas, for 21 days. His passport was valid till April 27, 2018, but officers of the Department of Homeland Security at El Paso reportedly said no country issues passports that have a 20-year validity and charged him with fudging the date without authorisation.

According to a letter by David H Burke, assistant chief counsel for the department, the charges were dropped after the consulate general in Houston informed the department that while Yellina’s passport had been altered, the change was made with the authority of the Indian government. He was released on January 28.

He was advised to obtain a new passport and seek a new H-1B visa, for which he has time till March 19.

In January, Yellina went to Mexico to get his passport stamped for converting his L1 student visa to the H1-B employment visa. On his way back he was detained at El Paso.

"I am happy that I have been released. But I still have to get my visa stamped from a US consulate or embassy outside America. It takes a long time to get an appointment at consulates and time is short," Yellina told IANS.

After completing a master's in electronics and communications from Southern Illinois University in Carbondale, Yellina joined GeoFields Inc., a Georgetown company, in May 2003.

In January, he went to Mexico to get his passport stamped for converting his visa status from L1 (student visa) to H1-B (employment visa).

When he was returning back to the US, Department of Homeland Security officers detained him in El Paso.

"On January 8, 2004, you appeared at the US consulate at Cd. Juarez, Chihuahua, Mexico, and procured an H1-B, non-immigrant visa, using an altered passport," the charges said.

On January 26, El Paso lawyer Marlene Gonzales filed a motion before the department to terminate all charges against her client along with documents from the consulate general in Houston saying his passport was valid and genuine.

so you never know what happens next second.
bad luck for that guy but he can sue now to get lot of money..
 
I doubt he can sue, -- It might have been possible if he was not given access to Indian Counsel, but with the PATRIOT law US has chosen to forego all international treaties and detain any immigrant they deem fit without access to Legal system (including notification to the immigrant's embassy). And with the court system these days being an extension of the Govt arm, I dont think much can be achieved.

How about "LETS GO TO INDIA"... Indian Economy is booming like anything & seems like Bangalore with become "IT HQ of World" Instead of Silicon Valley soon...

I read in Economic Times yesterday, Vinod Khosla (Co-Founder "SUN Microsystems") has more investment in Bangalore then in Silicon Valley today..

May be its time to go for I-1 instead of H-1..

The startling comment came from a local official and a lawmaker who opposed Infosys seeking state tax relief under an alternative filing methodology permitted by the California tax code.

In the dispute, Infosys, which has its US headquarters in Fremont, California, argued that the standard tax formula computed by the state failed to take into account that two-thirds of Infosys project work was done offshore in India, and that there was a 9 to 1 differential in the wages between its staff in India and in California.
