INS Auditing companies who apply for 140

Friends,
I need help.
I got my labor approved 8 months back through Perspective employment channel.
Now my attorney tells me that they cannot apply for 140, because INS auditing most of company financial records asking for net profits.
Is this true? anyone heard of this?
What are my choices?

If USCIS audits, what is the problem? As long as your company is doing things correct, why do they worry? This tells me that your company is doing some kind of violation and they don't want to deal with USCIS. Already you have wasted more than 8 months and Better change your sponsor.
