Hi,
I applied for my 485 on June 06 2007 under EB3 Worldwide.
My priority date (May 16 2003) became current this year from March - June 2008

My lawyer called USCIS on APR 13 08 and asked for an update on my case,
they were told to wait 30-45 days for update since the case was under normal processing time.

We called USCIS again on June 27 th 08 and were again told to wait 30-45 days for an update. The catch here is that visa numbers are unavailable for the year starting
in July.

My lawyer is advising me to go to the local USCIS office via INFOPASS and ask about my case.

Should i go or wait 30-45 days? The visa numbers will not open until Oct in any case.

WILL GOING TO THE USCIS OFFICE BE POTENTIALLY DETRIMENTAL TO MY CASE???

Any help will be appreciated !??

Thanks!..

It certainly will not be detrimental - why, do you think they will take some sort of revenge against you because you asked about your case?

On the other hand, it is very unlikely to be helpful either. If it is not approved by Monday, then talking to infopass will not change the fact that it won't be approved before October. The officer at your appointment don't have any power to approve your application.

Telling you to wait 30-45 days is the usual idiotic response. They keep saying that even after you've waited 90 days.

Go to the appointment to find out what is happening, if the processing time for your service center shows that they should have reached your case. But if yours is not outside the processing time they will tell you to run away, so check that first.

I give up. I was trying to think of a suitably idiotic response to this idiotic question, but can't come up with anything.

potential responses:
1. Jail
2. line up and get shot
3. start green card process all over again
4. start afresh from H1b all over again.
5. job becomes invalid. Leave the country, apply for a new H1b and wait for lottery
6. Might be deported to India for inquiring
7. Even worse, Might be deported to Canada.

Please feel free to add more suitable responses.
At this rate, I might get banned from this forum.

INFOPass appt

I went to the INFOPASS appointment.
They told me that my application was under back-ground check processing for over a year!!..

They were very courteous and apologized that i did not get this information from the NCSC over the phone even though i should have.
They added that i should take an appointment and come over to their office anytime i could not get
any question satisfactorily answered over the phone, even if i do not have a Service ID number.

I have read that USCIS is ***planning*** on clearing all applications pending checks for over a year by Nov 2008 and
going forward anybody whose application is pending background check for > 6 months will be given a gc (which
may be revoked if the background check comes up negative).

I am looking to hearing from other people on their experience with this process.

All in all it was not a waste of time at all !..

PS: Airherd (or whatever) ...Thanks for your concern!..
