Infopass Appointment at San Jose Local Office on 07/27/2007 - Screwed big time

My applications are in San Jose local office. I sought the help of Senator and Congresswoman from California. I was given shock after shock today.

I went to San Jose office at 9.15 AM and waited for my number to be called. Seeing me at the waiting room the Officer had my files ready. When my number is called I went and told that I would need to speak with Immigration Officer. He mentioned that he is the immigration officer. I asked about my status and the person holding my application brought the case to him. He went through the documents and asked me to wait.

He came back after 30 minutes and delivered shock after shock.

First: I am the primary applicant and PD is 11/2004. There is a domestic case and I told him all the Name Check is cleared. He said they had a conference call with Western Region and in the call it is decided that all unused visa numbers be given back to USCIS DOS , Washington DC. He said that there are some lucky applicants who got visa number assigned and my wife is lucky among them. But the irony is there is visa number assigned to me which technically means her visa number will be returned to the pool of unused since the primary(me) is not in a state of approval.He said that they are actively looking and requested the visa number and If I am lucky I will be assigned and approved otherwise I will have to wait until October 2007

Second Shock: My I140 is approved in EB2 and the Immigration Officer said that the visa numbers are requested in E37 Category. I was shocked and said my I140 is approved in EB2 but they said that they don't have the informaton. If in case i am not assigned visa number before then I belong to EB3 category even though my I140 is in EB2.

Can anyone suggest me anything? what to do with the EB Category and how i can change. I already requested Senator from Maine where the screw up happened and also in California so that they can fix things up. Is it possible? Are these things able to be fixed?

Do you have anything confirming IO words in written form ?
If not I'm not sure that Senator/Congressman inquiry will make any result be faster than start of magic 10/2007.
But you'd try anyway.
 
What about change in E37 to E21?

Confirmation for what? I had a written confirming words but not all.

I just want to know if it is possible to make the correction on E37 to E21 because it is their mistake.I am sure they cannot help in anyway for the Visa Number assigning to me.
 
I meant confirmation that they did put EB3 instead of EB2.
If that's true you can make them fix it for sure.
I saw similar scenarios on this forum don't remember exact link though.

How can I do that? I already contacted the Senators as I mentioned and given them my Approved EB2 I140 and Recepit Notice of I140. I sent them my MBA from kellogg and MS from Univ of Michigan too. What else do I need to do?

Can you give any suggesstions.
 
Dude, one of my other friend had a similar experience with San Jose office. His wife got her GC some 2 years back as his derivative applicant, but evertime they call him and go through W2s, employment records and all the other records etc and say that they will process the case, it still it has not happened.

Looking at the San Jose office processing speed I actually advised one of my friend moving from hayward to San Jose to consider not to cause if his 485 is sent back to local office for any reason, it will be SF and not SJ.

BTW, why did your case go to local offices?? USCIS seems better in approving cases. If there is any chance for them to send it back to USCIS for processing it might help (maybe) -- cause at least they have more visa #s than the local offices.

Also you might explore WOM possibility. And make a written complaint that it is their mistake to obtain a wrong EB classification visa ans you shouldn't have to suffer for their mistakes.

I am not a lawyer, but these are some of my thoughts......

What is the process of WOM

Hello Jack:

Is it possible for the derivative to get her green card without primary getting approved which is just waiting for visa number. If a visa number is assigned to my wife and mine is not assigned will her visa number be taken away? What is your friend's current situtation? Did his wife got her green card without his getting approved. I am very very frustrated with the San Jose office process. Yes you are right that USCIS seems better in approving cases.

I am still puzzled how come the service centers get more visa numbers and local office not getting them? What is the process of WOM? Is it possible to correct the wrong category?
 
WOM is not the right option for me

WOM is not the right option for me since the USCIS is responding and actively approve my case. I am just concerned if I can make them correct the mistake. Is it possible?
