I went for Infopass today and the lady told me that I should wait for my NC. I showed her the memo and she said that anyway, your case is at TSC.
I called to TSC after back to home. The lady let me call the National Service Ctr for any update. However she told me that they are still honor the 180 days Memo. Just wait for a little longer becasue they do not have neough hands to process these cases.
This is partly explain why we see many cases in 2001-2003 have been approved in past few months from this forum.

I-140 (EB1) & I-485: PD/RD: Nov 2004
I-140 approved in Dec 2004
I-485: pending since then

That's a long wait. I would strongly suggest either file WOM or at least start writing letters to have the paper trail in the event you do go for WOM. Some of the steps may even help your case move forward. If they don't, at least they can be used to prove that you have exhausted all avenues but filing a lawsuit.

Remember USCIS has no incentive in picking up old files per se. Old files have most probably been archived and it's anyone guess when they will get to them.

1. Write and fax letter to Director of TSC and request adjudication.
2. Write to Ombudsman and send an email as well.
3. Write to you local congressman and Senator

I have attached sample letter to Ombudsman's office, you can tailor it to your case details.

Good luck!
