Info regarding the difference in salary (LC and actual)

Hi All,

Last week there was a great panic regarding the difference in salary and the denial of GC for munnabhai's friend. Also guruashok had issues with his attorney in sending reply to the RFE in this matter.

I have sent the following email to my attorney and here is what he has to say (My LC was filed in RIR EB2 category)

In my I-485 the salary mentioned was 58000 , whereas the salary I am
getting
paid is 75000. I have sent this info to you in a paper attached along with
my forms that are signed.
I wanted to know whether any specific salary is mentioned in my LC (which
was RIR), if so will there be any issues with difference in salaries. Your
clarification in this regards is much appreciated. Also do you have any
status reg my I-485 application.

His reply

So long as you're earning at least the amount stated in your labor cert,
$58,000, you're ok. Your I-485 will take between 12 and 18 months to
complete.

This attorney has his office in DC and is pretty good. Regarding the second part of his email i.e., 12 to 18 months for completion of AOS like all attorney he too gives a safe estimate. During my I-140 he said it may take 8 to 14 months and within two months I got a mail from his office reg the approval.

He attached 1040 tax form (only one page) along with my I-485 application.

I know this info may not be useful to all, atleast people with my profile can derive some peace of mind??? in this isuue.

I do not have access to net from my office , if any info is needed i'll post response tomorrow night.

IMO munnabhai's friend's GC would have been rejected for misrepresentation in 1099.
