Info regarding FP

Hi All, I have a question regarding FP. My PD is 08/2002 under EB3 and RD for
140,485 is 10/2004. My 140 got approved this month. I spoke with my attorney and he is not sure about getting notice for FP. Should I wait till the priority date changes to 08/2002 to get FP notice and how about 485, will they work on my 485 petition too(after the priority date for EB3 moves to 08/2002)??

Going by written procedures, USICS is not supposed to work on your 485 till your PD is current. This should mean that an FP will not be issued till your PD is current. However, anything is possible so just hang in there and you will get your FP sooner or later.

If you check my case details you will realize that anything and everything is possible when dealing with USCIS.

I did get FP scheduled for next month.

PD:MAY/2003
I140 RD: JUNE 04 AD: JAN 05
I485 RD: JUNE 04
does it mean anything?
 
I didnt get the I-140 approved yet ( 2 June 2004 - concurrent), but I got the FP notice.

Now can anyone tell me what does that mean ? are they working on my 485 without first clearing my 140 ?

all this seems like a lottery man....there is no process ...everything is AdHoc

Its defenitely a lottery with the odds stacked against us :(. Retrogression has pretty much turned the table on an already messed up process. At this time there is no way to tell exactly how cases are being handled. Some cases are getting their 140s approved in a few months, some cases like yours and mine are getting FPed without 140 approval, there are a few other cases with a slight variation of processing. However, there is no way to tell exactly what is going on. All we can do is wait and hope that we get approved sooner rather than later.

my situation is like yours I140 RD is 07/22/04, FP scheduled for 03/24/05 (received 15 days ago), but haven't received I-140 approval yet...

a friend of mine who works for the same company i do, filed his case 15 days before mine and haven't received anything so far...(not even FP)...

it is really a lottery...we can do nothing...unfortunately.

Guys,

Just a thought. Maybe we are all in this special pile that has been designated to continue with concurrent approvals :) and we might all get the 140-485 approved at once in a few days .... hey .. there is nothing wrong with day dreaming :)

some guess work...

i am collecting info from here and there ( as we all are) on TSC 's handling of cases.

The attorney said that usually getting an FP notice means that they did a preliminary check on 485 and issued an F notice. this also means that they are going to keep working on ur 485 and keep it redy for approval once the Priority Date is current, since as per the Yates memo, for cases filed before 30 Dec, concurrent processing applies when priority dates are curent,

The reason this all is a lottery is bcos the processing officers.
We see people getting 140 approved bcos they got an officer who works diligently, while we either got a slow worker or someone who wont touch a case unless its near the processing time published on the TSC website.

So the only thing we shud hope for is that we get a 485 Officer who understands and adheres to the Yates Memo and does approve our cases once the PD is current since we applied before 30 Dec and shud get the benefit of Concurrent Processing.

You might be right in your thinking but this process will always be a mystery. I am just hoping to get approved soon and don't care how they do it. If you check my signature, you will realize that TSC has screwed up my case big time and the least I expect from them is to make up for their blunder by approving me in a timely manner now. I realize I might be asking for to much though .. TSC officers will do what they want, when they want ..
