Info. on class action suit against TSC request I sent to AILA.

Hey folks I contacted a rep from AILA about the possibility of a class action suit against TSC for these delays.
The person said that AILA will not work with individual clients (folks like us) but they will work with lawyers who are members of AILA to file such a suit (if necessary/possible).

If any of you folks have lawyers who are AILA members (mine is not) please request them to push for such an action so that we may all benefit.

ps: Yes of course your lawyer is obliged to your company and it is in the best interest of your company for you to stay in the same company as long as needed so your lawyer might be least inclined to take this on. But there are still a few immigration lawyers who have a conscience (ex: Khanna, Murthy etc.)
 
I think class action suite agains TSC will not help anything other than worsening the situation. Just pray GOD for the best and this is my opinion.

So you are saying that you would rather pray and wait and keep on waiting for your turn. From your point of view you could be right you might have a very comfortable job with no fears of being laid off etc. because of this bad economy. So you can afford to keep on wait. There are several folks who are in fear of lay offs and other personal/family reasons would want to get their GC so that they can move on with their lives. I have had several friends of mine who have lived in this country for more than 10 years go back to their country because of these delays. So if you are not willing to do anything about these delays that is fine. Don’t say that it will worsen the situation without any basis. Do you think that AILA and our lawyers will proceed with the suit if they think that it will worsen the situation? If praying to God would have helped us then we all should have got our 485’s by now.

lets say you want to pass some difficult exam. first u have to study and _then_ pray to god for the results, i.e., you have to do your hard work and then pray to god. just praying to god won't suffice. god won't help u at all.

same way, you have to fight, fight, fight till death :-) if you want god to support you. you have to do everything possible in your power to achieve something and then only god will like your hard work and perseverance and put in that little something extra so that you get it.

just a thought, thats all.

This forum is not a place like church. Also IIOs in TSC are not GOD believers like you. You can pray by yourself in home. God will not like what you behave. May God forgive you.

Atleast we know where we stand regarding the Class-action-lawsuit. Thank you for your efforts TRU.

I had contacted ISN last week, think I have to contact them again.

I also ran the script for 485s filed on 08/30/2001, and looks like TSC approved about 40% of the cases between late 2001 and end 2002.

GOD HELPS THOSE, WHO HELP THEMSELVES...

My lawyer is a member of AILA. She was assigned thru my first company. Later I changed company but she is still the same.

When I mailed her about this, she just BARKS at me!! She is a useless lawyer who believes in Waiting Game!!

I just expressed my opinion and all you guys posted replies criticizing me. I didn't even criticized or zanything like that...I just expressed my feeling.
Someone went to an extent that I have a comfortable job and no fear of lay-off. Buddy you are so wrong and I'm also on the same boat as others.
Someone is saying this is not church. Hello buddy there is no reason to be that sarcastic. cool down!!!

My personal opinion is class action suite doesn't help to improve the situation at TSC rather than worsen it because of law suit. This is my personal opinion and I just expressed it. There is no reason for all of you guys to bash me with your postings.
 
Anyways if expressing my feeling is wrong I will not post any messages here.

Sairam4599: Tru and others may have felt that their initiative may lack beef, if "negative" (from their perspective) opinions like yours can dissuade others from actively jumping into the 'Class-Suit' bandwagon. That doesn't mean, you are not entitled to your opinion.

Of course, people have become impatient, these days that they cannot brook any difference of opinion. Don't take it personally. You MUST voice your opinion, without any intimidation by others who may only pass satirical sarcasm to vent out their anger, frustration, or even plain humor.

Let us move on. Please continue to voice your opinion.

It i sstupid to think that only U can file a suit. There will be counter suits from BCIS. Theu will have many number of excuses to explain the delays. Just they can say "Security"
Cases will be adjourned for ever

Ofcourse AILA is not that stupid to believe that they can win against BCIS. Thay know pretty well that they will get a huge business if at all "WE" go after suing BCIS

We will definitely be loosers.

A law suit against INS/BCIS is not uncommon. If you go to ilw.com and read the archives you can read several such cases against INS. Closing this option out without doing any research on it seems very naïve to me. I am not an expert in law but if someone at AILA says that this cannot be done then we know that for sure, other than that every other comment can be construed as just personal opinion.
