Info needed

Hi,

I would like to get some info regarding the following.

- Sample format of Birth certificate (& whom to contact for notarize).

- My H1B and my wife's H4 expires on May 23rd and recently our lawyer applied for extension. we are worried that it might take beyond our expiry date. Is it a problem of "out of status"?. Can we stay here even if the extension approval didnot come on May 23rd?.

- How long (to apply and get it) it would take to get EAD for my wife, after we conurrently apply for I-140 and I-485.

- After 6 months into I-485, If I lose job, can I stay here in US and still process for GC>?.


Please share more information on the above.

If you get the receipt (which I'm sure you will get before 3/23) you are fine.

Answer: You can approach local municipal authorities in the city you were born to get birth certififcate. They will have their own format which cannot be changed so need for you to get a sample birth certificate format. Just make sure your BC has both parents full first and last name, child's first name, date of birth and place of birth. If you cannot get BC from the authorities ask them to issue a Non-Availability certifficate (NAC) and you will also need Affidavits fo Birth from the parents or closed but elder siblings or relatives on s legal stamp paper. (For affidavit of birth templates search in this forum)

Answer: The fact that you have applied for your h-1b extension and wife's h-4 extension means that you are in status and you can legally continue to work (not your wife) with affecting your immigrant status. MAke sure you have your H-1B application receipt which is a proof that you are in status and eligible to work.

Answer: Technically in that situation you need to find a job within reasonable time. What is reasonable who knows? Getting EAD doesnot mean getting GC....one needs to have a job at least until GC approval date or if one loses a job while on EAD, he/ she needs to find a job asap coz if there is a RFE from USCIS then it can cause a lot of immigration issues!
