Indian Parent and dependent sibling green card

Hi,

I hold a US citizenship. I want to apply for a green card for my Indian parents and dependent sister (Unmarried, 39 yr old, Autistic). How long does the process take for parents and my sister. Would my sister’s case be considered normal or be impacted due to medical condition? If impacted, what could be the impact?

US immigration law does not make exceptions for dependent adults, and in any case the visa category your parents would be on (IR5) doesn’t allow dependents. You would need to file 3 separate petitions, one for each of your parents (IR5) and one for your sibling (F4). Overall, the fastest route for your sister is likely to be for your parents to file an F1 petition for her once they have their own green cards - wait time for F4 for India approx 18 years, for F1 approx 9 years. Obviously neither is fast in absolute terms, and if your sister cannot live on her own it’s a problem. Perhaps a way round is for only one parent to get a green card initially and the other waits with her and both other parent and sibling get green cards later.

It would be F2B, though it would change to F1 if the parent naturalized. F2B is actually ahead of F1 in the Final Action Date chart, and they can opt out of the change to F1 if they wish.

Oh yes, good catch.
F2B looks currently about 6 months faster. Of course all these wait times can change significantly over time too.
