Incorrect DOB on both EAD & AP - what should I do ?

I have an incorrect DOB on both EAD & AP - they have swapped the month and day..we went to the local INS office in Boston to see if they could do anything about it. The guy there was on a power trip and said it was VSC\'s mistake and they needed to correct it..does anyone have any suggestions - we are travelling to india next Wednesday and need the AP to travel.
 
My lawyer said that it wasn\'t a BIG deal and that we could travel and use that EAD..

So, we haven\'t got it fixed or any such..
