Incompetent INS

I am so frustrated and I could hardly count on approving my case soon on the incompetent INS, their rules and their work culture. I have been living and working in US for more than 8 years and maintained status all these years. In my case I feel like they mocked compentency, rules and everything and added to that the non-availability of VISA numbers crap.
I just want to know you guys opinion in my case and choices I got other than AC-21

Labour PD 03/02 EB3 ( MS Comp. Sci. )
I-140/485 RD 03/04
I-140 AD 03/05

EAD2 AD 05/05
FP2( code 2 BIOMetrics) 06/05

I485 AD: ??

As much frustated as you are

Where as MY PD is October 2001. I am also EB3, I 140 approved a month ago. Now this heck with Visa not avail. This just Sucks

I think OUR only choice is AC21.

Just as frustrated.
PD is 05/2001

I had to leave US after 6 years and then come back.
Working in a job I hate.
Life is just miserable!!!

At this point the thrill of getting a GC is replaced with a question of where my youth went.

I am hoping all the wait is worth it.

I share your fustration, I completed my 6 years (in Feb, 2005) but had switched on to AC21 , and changed my employer in June of 2004.(Only after I-140 approval and 180 days of I-485 filing)
I informed INS about my switch. Got an RFE , responded on the 17th of May, 2005 and still waiting ...

I think I have wasted my 6 years of my life here working in a job that I mostly did not love or was never passionate about...
Certainly need to think if it is/was all worth ...

Guys, I couldnot agree with you more! Its so freaking waste of our valuable youth/time and here we are still struggling to make it through. The unfair treatement meeted out to us is outrageuous, while every Tom and Dick is gettting GC approval ( I am not envying them .. but just disgusted).I totally lost faith and trust in US on the eve of her I-Day.
They say "America is a beacon of freedom blah blah blah.. ", after almost 8 years of slave labour and god knows how many years to go, it just doesnot make any sense.

Share your frustration.

I certainly share your frustration.

My 6-year on H1B will end in March 2006.

See my signature for details.

Hate to tell you, your employer and/or lawyer screwed you badly by applying in EB3. I have seen people with B.com and B.A. getting approved in EB2.
In this case, your anger in misdirected.

I certainley share your frustation, I have been here since 8 years and did maintained legal status also made a substantial contribution to economy. well now I made my move and used AC21 and switched job, my salary is hiked by almost 60%, I am planning to write to a local congressmen and explain myself, I really don't care much about my approval

Also, I don't blame INS, I just blame myself about bad choices that I made, it just followes policies which grossley influeced by corporate sector, now they are giving green card nurses due to huge demand, we all know none of the corporate will ever lobby for us,

Hidden costs of greencard process

Welcome to the capitalist world. We have been submitted to this low profile greencard process treatment waiting several years to get a work authorization. That just tells me how miserable our countries are. It is all about supply and demand here. Since the supply of third world engineers are in high demand, why should the US government bother to give us a better treatment ? The hardest hit is in my family life. Instead of getting disappointed with the US, I actually get disappointed with my country, which is a nest of corruption and violence. I would like to see another superpower emerging and maybe making the US to invest more in resources to treat us better.

My wife resigned from her entry level engineering position in South America and joined me here in the US. Well, she didn't have enough background to apply for the H1B in the US and that means she has been unable to work for 5.5 year now. She is sad with all this and I am afraid this friustration will never go away, since she is no longer so young to start in entry level positions anymore.

Also when you take into account the fact that you are away from your family and all that... I am not sure if all this is worthed. Ironically, now that I've got my I-140 approval, it took so long that it is already time to make thing going back to my home country to spend a time with my parents who are getting old.

The US doesn't deserves, folks - and to many of us, our home countries do not deserve us either. In my humble opinion, the lesson in the end is that I need to stay wherever I am happy and safer, and closer to the ones I like.

let's just hope future generations won't suffer as much

for those who might want to get citizenship, please use your votes to change this unfair process.

Ironically...

I was going through other forums (For Citizenship and stuff) , I was surprised to see quite some people "worried" that they would not get their Citizenship due to felonies (like shoplifting, wife battering, domestic violence, theft, misdemeanors) ,Ironic that educated law abiding people wait like animals. While people with IQs less than 50 get free ride just because of their nationality.
It is unfair and unjust.

this is really a digression

I am not sure how long you have lived in US but if you have lived here long enough, you might have realized by now how easy it is for petty offenses to be taken extremely seriously by law enforcement.

Many so-called deportable crimes (or crime of morale turpitude) aren't so much a big deal for American citizens.

Considering the fact that the US President has drunk drivering record and have to get special pardon to get into Canada ...

Let's just wait and see whether Russell Crow will get deported because of throwing a telephone to someone...
