Income Tax Returns

Hey Guys,

Here's my question..

I am in the process of completing the I-485 forms. It asks for my husbands last 3 years of income tax returns. Now we both were living in Australia for the last 4 years, just got back last year.

Therefore he only has one U.S. Income Tax return which was only for 3 months last year. All his Income Tax Returns relating to income is from Australia. He has Income Tax Returns for U.S. for last 4 years but they have no income on them cause we were in Australia.

Does that make sense? So my worry is how do I prove the above poverty guidelines when his income for last 3 years was in Australia and not U.S.A.?

He is working and his income is above the guidelines but how will they judge it when he hasn't been employed in U.S.A. or in that company for 3 years?

I am not sure on this but if your husband is a US citizen or permanent resident, he is required by law to file US tax return and show income from ALL sources. Taxes are required to be paid in US for all worldwide income. If taxes are already paid in AUstralia, he can claim that as a deduction.
