Hello All,
I just needed some suggestions regarding this issue of 213.... regarding inadmissibility. Like many in here, my father too has been found inadmissible. How? Why? God knows. It makes absolutely no sense that upon seeking asylum and actually after fleeing the country fearing prosecution, the homeland security has found him inadmissible.

Anyways, since I'm a derivative asylee, I'm also subject to inadmissibility upon my arrival at POE, should I depart the US. As it stands, I've already bought the tickets to leave and I'm seriously considering leaving the U.S. in September.

My question is, what is the worse that could happen upon my arrival? Will I be sent back? If thats the case then how long will I be barred from entering the U.S.? Does anybody have any experience with inadmissibility?

Don't know. He received the same standard email ( you appear subject to inadmissibility .... 213.(a)(3)(b)......that USCIS has been sending out to people who've made an inquiry about their pending I-485.

I googled "213(a)(3)(b)" and it says "is the spouse or child of an alien who is inadmissible under this section, if the activity causing the alien to be found inadmissible occurred within the last 5 years".

Based on what Walker just mentioned above, I have few concerns If anyone can help me with it.

I am currently an asylee applied for my I-485 back in 2008. Still no updates whatsoever. I do have an RTD which I received few months back and I am planning to travel in Aug. Now my question is, what are the chances If they put me in the same category while I'm outside of the country??? And what are my options in that scenario Or Do they even issues RTD to those who fall in such category???

Thankful, Koteya etc. Please any input will be greatly appreciated. As I've already made the reservation and its just a matter of couple of days before I buy it.

Do you know the reason your I-485 has been pending for so long? If it is outside the processing times, then you should take action.

They issued a Travel Document to my father and me. We applied it 3 months ago, and received it after a month.

They said its stuck in name check/background. I also made an Info pass appointment and received the same answer. Is there anything else I do can to expedite the progress.??

So this is the reason I'm little concern about my travel overseas and If anyone has any answer or advice to my question, It will help me in making a decision. I just want to be little extra precocious before I travel abroad. Thank you everyone for your responses.o

Could the likes of Thankful and other knowledgeable members shade some lights on this matter?

Surely, there's gotta be a way to assure that I won't be sent back upon my arrival back to the states, should I decide to leave.

Koteya,

Doesn't this refer to me?

"VII) is the spouse or child of an alien who is inadmissible under this section, if the activity causing the alien to be found inadmissible occurred within the last 5 years, "
