hi, everyone
I have a strange question.
I am currently in the process of adjust my status in the US.
My husband is USC, and I am applying green card.
Haven't received interview letter yet.

But my mother's health is not doing too well.
So we are thinking about move to my country for a while.
But by the time when we move always from US, all I have maybe is the conditional green card.

I know if we moved, I will lost my card right?
will I be able to apply for it again when we decided to move back to US couple of years later? Will that be much more difficult?

thank you :)

Oh....

Cindy,

Sorry to hear about the failing health of your mom. I hope that she gets better for you guys....

Couple of questions: How far are you in the process? Did you get your FP done, if you how long ago was that? In most case, it could be a couple of weeks before you are called for an interview and hopefully be approved on the spot. If this is the case, you could get your passport stamped and you and husband can just leave the country immediately. However, prior to leaving, send a change of address USCIS and have them send all your mail to your husband parents, so that when USCIS send your greencard, it is not returned to them as undeliverable...

However, even with your conditional green card, you want to maintain your residency status in the US. As such, if you plan to apply for US citizenship based on the three year rule, then you want to be in the US twice a year before the end of each 6 month period, so that you don't lose your continuous residency.... :p

If you have no confidence in the speedy resolution of this case, make an info pass and find out what are the procedure to transfer the case to the US consulate in your home country and find out if they can't issue you a GC there, I doubt though.... If it is feasible, transfer it and move there and get it done while you are in your home country....

Hi:

Unfortunately GCs are not issued at consulates abroad. I think you are referring to her going through consular processing instead.

thank you for both of your advice.

I am already finished my finger print.
Now is the 5th months after my ND.
Still waiting for interview letter but I am hoping it will come soon and everything can go smooth from there.

We are planning maybe move back to my country this August. So I still have about 8 months.

Sounds like after I received my GC and go back home, will be a better situation, right?

So, just double check, is that mean. After I received the GC, I have to come back to US at least every 6 months? to maintain my resident status? and that is all I need? So after 3 years, I can still apply for citizenship?

thank you,
:o

Yes...

Piano,

Yes... I had meant for consular processing... I am aware that GC's aren't issued in US Consulates abroad...

Hi:

Good - I was pretty sure that was what you meant. I just wanted it to be CLEAR.

Best wishes.
