Hi Gurus!
I need some advice and based on that I need to act fast. I wish to file in 2001 so will appreciate your response at the earliest.

I am on H1 in US and completed 3 yrs in h1-b status and not started green card. 3yrs remaining provided I continue to be in job(?? layoffs continuing and economy not picking up). I wish to apply Canada immigration becoz in C-11 the new residency requirements will be 730 days in 5 years. So if I apply now I will be able to get in 8-10 months and then if conditions are okay in US I can continue on H1 status for the remaining period and then goto CANADA for good. Meanwhile after getting Canada PR I will go to Canada and return back .If I get laid off before 8-10 months from now I will still continue to remain in USA till I get Canada PR by changing status to B1 or F1.
Regarding new point system
My age - 35 : 10 Points
I have a Masters from India - 25 Points
I have been working in my profession for 7 years - 25 Points.
I am very proficient in English - 16
My wife has Master Degree - 5
Total 81:

Questions 1) Does my plan looks okay or I am incorrectly considering somethings and /or missing others...

IMPORTANT INFORMATION FOR ECONOMIC IMMIGRANTS

Under the proposed regulations of the new Immigration and Refugee Protection Act (expected to be implemented June 28, 2002), for Skilled Workers there will be an important distinction between applications received before and after December 17, 2001. Specifically:

Independent and Assisted Relative immigrants who are interviewed (or have had their interview waived) before implementation of the new Act will continue to be assessed against present regulations.
Independent and Assisted Relative immigrants who apply on or after December 17, 2001 and who have not been interviewed (or have not had their interview waived) before implementation of the new Act will be assessed against the new Skilled Worker regulations and a pass mark of 80.
Independent and Assisted Relative immigrants who applied before December 17, 2001 and who have not been interviewed (or have not had their interview waived) before implementation of the new Act will also be assessed against the new Skilled Worker regulations, but require a lower pass mark of 75.

Question 2) Is my understanding about points and residency requirements correct ?

 You should read the compleate regulations which are proposed and if you feel you can qualify you can file for Canada, regarding the the residency requirement do not jump now just reading the First published regulations wait for the Final regulations, and when they will be effectiveThey say by end of June 2002, and only then it will be clear in detail. If you feel you qualify then apply because backlog 95% will be cleared then and if your are OK according to New piont system your file may be approved in 5-6 months. Other Important factor is that US economy is in bad shape and I do not think it will pick up in 4-5 months and if you are laid off then you have to leave US and your File according to new regulations should be submitted to the consulate near to your residency, suppose you send your file from US to Buffalo in Jan/Feb 2002 and something happens to your H1B status then you have to leave US in that circumstances your file will be returned and you are going to loose the fees as you may not be in US, You should wait for some time. the IT jobs are NOT availabe in Canada, I know many who have landed are not able to survive or get a job, they are doing some labour jobs or eating their saved money .

you should do what ever is in your intrest.I suggust wait for the Final regulations and to be effective.

Thanks a lot...Still confused about file transfer

Hi Inder!
Thanks for taking out so much of time to answer my queries.
But out of curosity I cannot still understand why I would not be able to transfer my file (and loose fees) to India in case I do not physically remain in USA. I see on CIC web site and they do it for $100 canadian. Although what I understand is if you do file transfer your case will loose all priority and will start from scratch.
I tried to read the fine prints in document publised in gazette but could not find anything related to file transfer?
Did you see anything in that document related to file being returned or loosing fees.

Yes I was refering to that only

Because under current law you can transfer your file by paying CDN 100,What ever you wrote is correct. I could not find anything related to New Law/regulations in regard to file transfer.
 
I got my PR 2001 AUG and its going to expire does c-11 benfit for me i am in USA if i don\'t go to c
