In AOS and H1B expiring within a month..do I need to apply for H1 transfer soon?

I have filed for AOS in October 10th and got laid off in the first week of Dec. My H1B visa is expiring on Jan 31st. I am currently looking around for a job now. Just wondering if any of you know the answers to;

1. Should I apply for a H1B transfer before Jan 31st or is it safe to apply it later than that date?
2. If I apply later than Jan 31st, will there be any legal complications pertaining to maintaining status?

Please give me your inputs to this case.

Not applied for EAD while on AOS and employer has sent notification to INS

No I have not yet applied for an EAD....do you think I should? It has been just about 3 months since I have applied for I-485. My employer has already sent a letter stating that I no longer work in the company.

Given this situation, how would you or anyone answer the above questions? Please let me know.
