I think retrogression is here to stay. DOL/DHS/USCIS will need a lot of time to fix something that they have messed up in such a way.
One fellow who applies from Detroit in August 2001 is still waiting to file for his 485 and another fellow who has applied from Maine in August 2003 has a green card and it's been a while since he got it.
Why ? This is because DOL has a different office in each region and each region works differently. This is prior to the establishment of BECs etc.
Meanwhile a whole lot of people started applying their LC from places like Iowa, Maine, New Hampshire, Delaware etc and file for their 140/485s and are happy with a GC in their had and "ate" the visa numbers that were available which should have been used by the people who applied for LC before but got stuck because they applied from NJ or MI etc. Enter PERM and the whole process got a new dimension with Labout approvals taking ridiculously small time and bingo !! People are ready to file for 140/485.
It is going to take a lot of time for the whole process to be fixed. law makers are least bothered because we guys cant vote any way. So, basically no one cares. I used to care about the VB - I have a priority date of Sept 2002 - EB3 - India. I filed for my 485 but cant do the same for my wife as I got married during the period of retro. Law suits dont matter as USCIS has never guarenteed that one will receive his GC in a specific period of time. So , what can we do ? Take it easy
