I have a very interesting situation, Already in 7th year of H1(Valid until May 2007) and last year got my Labor cert and 140 approved thru PERM for future employment via a different employer. My questions depending on the above status situation are:
1) I am travelling to India in December and have an appointment for revalidation in Jan'07, If for some reason visa issuance get delayed and I reach my 797 expiry date, what are the options thru the current employer to file for my H1 extension? and
2) Can my new employer with whom I have my LC and 140 approved for future employment file for my H1 If my current employer terminates me, while I am in India.
I would appreciate if you can provide answer to my questions above.
