I got my H1 B visa in November 1999 and came to USA in January 2000. From Nov. 1999 to Nov. 2005, I will complete 6 years of H1 B Visa. In the year 2004 beginning, when i renewed my visa, the visa was issued till Sep. 2006. I am confused now, whether i could use my H1 B till sep. 2006 or do i have to apply for an H1 extention in Nov. 2005.

Secondly, someone told me that if you have already applied for an EAD card and got approved, then you cannot file for H1 B extention for seventh year. Is it true?

Please help me gurus....

Thanks...

Your 6yr H1B period starts only when you enter US and not the time you got your visa stamped in India. So officially speaking, its Jan 2000 you have your H1B started. Also, when you apply H1B extensions, they consider all the period that you have been out of US to give you that time when renewing your H1B extension.

You can file H1B extension even if you have an approved EAD. You are OK.

Thanks Want GC Soon. I entered us in January 2000 and haven't left USA till date. So practically my H1 B should have been till January 2006, why September 2006?
Any Clue?

You might have renewed your Visa using a H1 Extension. Right?

Till what date your H1B issued?

nope i haven't renewed my visa using h1 extention. I renewed it in first quarter of 2004, at that time my 6 years were not over. but i got the visa till sep 2006. Strange hah? I was wondering if it's a mistake on USCIS's side. what's your take on it?

The dates could be misleading sometimes. I myself had a hard time figuring out the dates for my H1-B. However, to be on the safe side, consider January 2000 - January 2006 as your 6-year H1-B validity period. Hopefully you got your GC before Jan 2006 but in case not, make sure you apply for a 7th yr extension few months before Jan 2006.

There are two dates on your VISA

One is EXP. date: This can be anything. I had it Feb-03-2009 : I don't know why.

The second is PDE: (This is the expiration date of your h1 VISA), look for it closely on the VISA stamp.

Hope this helps.
