Hello all,

I'm in a very difficult situation here....
I'm working with company A at Client B... I filed my GC with company A some time ago and Labour Certification has not finished. Now, my Client B wants to hire me... and my six years limit is going to end by May next year....

My client's immigration attorney says that the labor certification from company A can be transferred to Comapny B once it is approved... Is it true? Has anyone out there heard something like this?

Please advice.... I need to make a decision by the end of the day today... Please respond.....

Thanks,
Sri

From what I've heard, LC can be transfered if old and new job descriptions are very similar and it is the same work site (meaning same state).

Based on what little information you provided, I would say no. There is no provision that makes Labor Certifications portable in this type of situation.

One can't transfer approved Labor from Company A to B. I guess someone missguided you. On the other hand if u quit from company A then they can use that approved Labor foe another employee in certain conditions.
