We have done very good job in pushing 8001 (recapturing unused visa) in the budget recon bill. However, we have not focused much on the recent bill (HR4437) passed in the house. We are assuming that this bill focus only on "illegal immigrants" by enforcing tough policy. But it affects legal immigrants also.

It has very posionous provison by enforcing "criminal" charge if any one out of status. For example, though we are legal immigrants, by chance we may forget to file H1 or H4 extension on time or our I-94 expires without our knowledge, then govenrment can file a criminal case. This is very serious issue. Also, if any one caught under DUI, (whether he is legal immigrant or GC holder or illegal immigrant) they are deportable.

Let us assume if we get GC fast, through the provison in S.1932, and caught for DUI .. imagine your life.

Therefore, we need to oppose this bill as the same momentum that we are showing in 8001. For more information visit AILA.org web site, Fragomen and Cyrus Mehta web site.
 
can_card....sorry man.....i am ok with supporint things related to anti-retrogression.......will do more if required........but political activism...is not exactly something i am looking forward to doing now.........

I agree with techny2468.

Would you not want to do the maximum harm to that person who was drunk and drove over you??? And if someone is stupid enough to drink and drive then they need to be thrown out of this country.

Also, if some one breaks the law they need to be prosecuted to the fullest extent possible under the law. If you are not illegal (and I am assuming you are not), then please do not start planning for the day when you will/may become illegal and/or break the law.

i agree with ecnirp11......DUI is one thing....i will never do now......cant pay such a price for such a stupid thing...

and i dont think i will ever become illegal.....if i will then i will appeal....because i dont beleive that you will be blamed for murder if you happen to have a knife next to a dead body(hindi movie style... :) ) ....this is a blanket law to catch illegals....and those who knowingly overstay their visa.......right now we need to focus on fighting retrogression...
 
I am not supporting DUI or any other activities that breaks the law. What I am not supporting criminalizing immigration violation. The terms in the bills are so broad, it may harm for an innocent mild violaton, if any one wants to misuse the law against you.

For my doubt.. Are they throwing out U.S citizens out of country if they caught under DUI?

Your conerns are vlaid. However, like techy2468 said, lets first concentrate on getting our GCs and then we can start lobbying against this draconian bill. DUI is not good at all but the difference in punishment should not be such. I agree that the immigrant community will have to fight this. More than the DUI issue the major problem I see with this bill is that it makes overstaying on a visa a "FELONY". This is bordering on the insane. Mistakes can be made and to throw someone in jail because they may have broken a stupid immigrantion law is not just. This bill pretty much says that if you are not a US citizen you'd better watch your step or you will be thrown out for any minor offense.

Lets look into this one next year when it will be considered more seriously.
