Important AP question. Please respond.

My daughter is with pending application for permanent residency(I-485) and has advance parole which will expire in Oct 2003. She wants to go to India in June 2003 and join in the college in Sep 2003. We are planning to apply for AP extension before she leaves. My question is when can she apply for extension of AP (how many months before we can apply for extension) and can she leave US before her new AP approval. And can she re-enter US just before expiration of new AP which would probably around in Oct 2004 or right after her I-485 approval whichever comes first.

Hello ,

Six months before the expiration would be the ideal time for filing the extension . Sometimes INS will return the applcation back saying that "Too Early filing" so you need to be very careful when filing the extension.
I filed my EAD/ AP entension 5 months brior to the current

(The above statement was told by my attroney)

Thanks for the info. Can you or any body tell me, is it ok to travel while the AP is in the process?
 
Better to travel after AP approval

To be on the safer side, it is better to have an approved AP in hand before leaving the country. That was my attorney's advice when I travlled abroad.
