Impact on Spouse's case after Citizenship

Hi All,

Here is the situation for your review.

1. My oath ceremony is tomorrow September 25, 2007. Hopefully I should be able to get my Naturalization done tomorrow.

2. My wife's I-130 petition has already been approved, and her case has been sent to NVC.

3. NVC sent me (sponsor of wife's petition) the Immigrant visa bill form, and fees to deposit.

4. I have already deposited the fees, and NVC has cashed the check.

5. NVC has now sent us Immigrant Visa Application form for my wife to be completed by her.

6. Her visa will be issued at Islamabad Embassy in Pakistan.

Here are my questions:

1. Should I apply for her K3 Visa now that I have my Citizenship in hand

2. If I dont apply for K3 Visa, and rely on NVC; how long will it take for her to get the immigrant visa provided her cases is on the step mentioned on bullet #5.

3. Should I take my Citizenship evidence to Senator and make a big cry for my wife's visitor's visa.

What do you guys recommend....of course like all of you I want her to be with me ASAP:)

ASSUMING your wife has a current priority date (PD), NVC is taking approximately 4 weeks to complete processing of the DS-230 and sent the case to the appropriate consulate. Add an additional month or so for the consulate to generate an interview appointment, and your wife is well on the way to being done. (Note: these timeframes are based on recent NVC dates for my Mom's GC)

If you swap to K-3 processing, would that mean you'd also switch over to I-485 AOS? If so, I suspect it would take longer than following CP through to completion. Of course, your wife could still travel back to Pakistan for her interview.

The other aspect of this is that if your wife's PD is not current, you will need to write to NVC and request them to upgrade your case to IR (immediate relative) status once you become a USC.
