Impact on Retrogression- Dpendent with primary approved

We all know by know that EB 3 will retrogress to Jan 2002

question for gurus:

1) i am dependent on wifes eb 3 485 with PD of august 2002

2) primary was approved oct 2004

3) rfe was generated on dependent (my) case on dec 6

will i get impacted by the retrogression? when they count the quota do they factor in dependents that havent been approved or rfes that have been generated???

Hello... With all due respect, I am certain about reading a post in here (I am sorry for not remembering where I read it) but the only group that does not have the priority date is Immediate Relative 1 - spouse of an U.S. citizen but the rest is subject to PD.

Despite the existing correlation between approved primary and pending derivitive, I think the derivitive's application is still subject to priority date.

In any case, it is my hope that this person's pending derivitive application would be approved before 1/1/05.

RFE details

Can you post the details about RFE? I am in the same situation - primary's application was approved on 08/2004, and USCIS issued a RFE on 12/17/2004 for the derivative. I don't know what is about, and with Holidays coming I'll probably get it after Christmas.
