Impact on Labor Condition after sponsoring company get acquired by another

Hi friends,

Can you please let me know the impact on pending Labor Certification for green card, if sponsoring company is acquired by another company.

for example I am working for a company A and my LC for GC is in pending at federal. But company A, is getting acquired by another company B.

Can I still utilize it for my green card after the acquisition.What is impact on my green card process due this acquisition?

Yes.. the LC is still valid if the aquiring company is still willing to sponser you.

Actually the current company and acquiring company are in different locations. For now they are keeping the current(acquired) company in current location.
My concern is what will happen after some time before LC approval, if they(acquiring company) change the current (acquired) company location? any issues?

I am in the same situation as you are in. My lawyer says nothing changes. Make sure you have documentation about the acquisition, something like a press statement. The acqusition must be both "Asset and Liability" acqusition. Even your h1b does not change I am continuing on the same H1b visa

If the new location is in the same area ( say Bay Area) it may not be much of a problem but for long distance / inter state move DOL might present some issues... once you get your LC, it may not be such a big problem for USCIS if its only intrastate move.. for Interstate you need another LC.
 
Yeah, even my laywer also saying same thing *No Impact* at all.

I have asked the lawyer about the change of location question. Here is the response.

"The labor certification is specific to the Bay Area.....If the job location changes, the labor certification can't be used unless you are at the point where your I-140 has been approved and your adjustment application has been pending for 6 months".

Back to my situation:
The acquiring company is the California(CA) state only and my current company in Bay Area.
Since both locations will come under same DOL, it may not be a problem even of they moved company out of bay area..

please advice if my assumption is not correct.
 
U are fine. My company is in Atlanta and acquiring company is in Bay Area but we still operate out of Atlanta. My lawyer told me there is absolutely no impact
