Impact on 485 status?

Hi,
  I filed my I485 in 12/7/2002, and finished Finger Print on 4/25/2002.
  I have a new baby and need my parents to take care of, and I want to extend my parents B2 visa (they are already here). I am considering the worst case, if the extension is denied and I still want my parents to remain taking care of my baby(I know the consequence for them: they will never come to US again, they are old and probably never will), is there any impact on my 485 case towards Green Card.?

So you want to cross legal rules and restrictions out here. seems like you got big fraud thinking...in mind. these kind of frauds may create lot of problems and may lead to introduce lot of restrictions in future.

think abt it...!

I think you should first try to get an extension. If you are denied and you adopt the route you explained, then you should be prepared to face the consequences :

a. Your parents may face a entry ban into US (You are already prepared for this).
b. You may be held liable for motivating them to do so (may also face criminal charges!) - a worst case scenario of losing ur green card and deportation.

Again, I am not trying to scare you. Under current circumstances, anything is possible and we the \'legal aliens\' should be extremely cautious of What we do and what we say!

Frankly, I think leaving the country and returning is a better option. It is a hassle, but is legal and safe and will not put your \'legal residence\' in jeopardy.
However, as I-539\'s are taking between 120-180 days (Maybe longer than the period that they will be approved for anyway), you can apply and see what happens. In the meantime as you have the receipt, they will be in status.
 
Leaving US and returning later is likely to be a better option

Filing for extension does not keep you in status in case the extension is denied. And, if the extension is denied and they do not leave by the current I-94, they will cancel the visa. This means that even if the reentry bars do not apply (I believe they apply only if you stay illegally for 6months or more), they will need to go the consulate for a visa. And, one of the questions on that form is `was your visa ever cancelled\'

If they return to India, they can revisit after a month or so. The INS agent at the border may ask questions about a quick visit. As long as you can make a story, you should be fine.
