I am asking this question for a friend of mine who is currently in India. He came to US in 2004 for graduate studies. After finishing his education in two years, he was unable to get a job and he did not apply for EAD. He graduated in May 2006, but stayed in US till June 2007. He left before his 3-year student visa expired. I presume that he was out of status since he was not enrolled full time in college and was not working using EAD.
Currently he is applying for jobs in US. The question is, if he gets his H1-B visa sponsorship, will the consulate grant him H1-B visa to come and work here?
