impact by prirority date retrogression on me???

Will I be impacted by prirority date retrogression on EB3 applicants from India. I filed Labor Substitute I140 on 02/27/2003 which got approved on 03/04/2004.

Labor Applied on 04/21/2001
I140 ND 02/27/2004, AD- 03/04/2004
I485 ND 07/25/2003
FP 10/07/2004
RFE on Medical 12/02/2004

Till the dates become current for you, your case won't be adjudicated...Just hand in there

As of now no one knows for sure what USCIS does with pending 485 EB3 PD> Jan 02 cases. My attorney says something completely different to what Murthy.com mentions. So wait till March of 05 and see the pattern of approval.

You are safe....the current dates have retrogressed to 01/01/02 and you are fine....chill

I checked I140 Approval. On I140 approval my proirity date is 03/05/2002. So I guess they will count this as my proirity date.

So here are my details

Labor Applied for Somebody else 04/21/2001
I applied I140 ND: 02/27/2003 (used Labor Sub)
I140 approved on 03/04/2004 (PD on i140: 03/05/2002 .. i guess this is the labor approval date)
I485 applied on ND: 07/25/2003
FP Done on 10/07/2004
RFE received on 12/02/2004
Sending RFE response on 12/14/2004 ... praying to god that it gets approved before Jan 01st

Typically PD is the date when the labor application is received by the state office. PD is rubber stampped on the labor application. Why dont you cross check the approved labor certificate.
 
what is 3/5/2002?

it can be either 140 RD I.E. 2/3/03
OR LABOR RD I.E. 4/20/2001

I guess you misread PD somehow.
Most probaby the preapproved labor had RD of 3/5/2002.

Please double check.
 
Hi Guys I think some people are confused about the priority dates.

Please read the link about PD from murthy.com,.... This PD date is not a new thing. It was there long before in 2000. See the article which posted on 2000.


In Simple english.....

Who ever initiated the GC process after landing in USA first,will get their 485
processed first irrespective of whether they filed 485 or not.
Who ever got their 485 approved are OK and lucky.
