Lets say the situation is like this:

1) I am in H1B
2) I form a company with an American Partners and Venture Capitalists.
3) I own 40% of the company when the first round of funding is over.
4) I have an MBA in International Marketing and B.E. in Computer Science
5) Company employs more than 15 Americans or Permanent Residents and has a proven capital of $2.5Million (from the funding round)

Can I apply for an H1B from my own company for the post of CEO and work for the Company in that position ?

Can I apply for Green Card from my own company as I am employing more than 10 Americans ?

All the info I can get on this from anybody will be great and helpful.

P.S. Joe, I think your assertion that you cannot have an H1B management position is not entirely correct, as I currently work as a Director for a Large Prominent Silicon Valley corp and my H1 states that my job requires an MBA and includes job description in which my primary job function is Managing people and funds..

I would like your knowledgable view on these questions Joe.
