I. IV MEMBERS AT EVERY STAGE
• We have members at each stage of the process: labor certification backlog, retrogression backlog, USCIS backlog. Some of our most active members have not got their labor certification.
• Members who are further along have not forgotten the length of delay and pain of the previous step. We are ALL really in the same boat.

II. WE EMPHASIZE THE EFFECT OF CUMULATIVE DELAYS
• The most devastating problem for EB green card applicants is the cumulative effect of delays at each stage. Each delay in isolation may even be bearable (only in theory) but when you pile one on top of the other it is unconscionable. We emphasize this in our new presentation (out shortly).
• When we meet with lawmakers or talk with other organizations in the coalition we give personal examples and it is this fact of delay piling on top of delay that most of them are shocked by.

III. DOL-BEC & USCIS BACKLOGS ARE ALREADY SUBJECT TO CONGRESSIONAL & PRESIDENTIAL MANDATES
• DOL-BECs were created as a result of considerable protest and intervention by Congress.
• USCIS Backlog Processing is also subject to Presidential mandate – for 6 months processing by September 2006. Congressional hearing transcripts show that members of Congress are well aware of these issues, even the problems with repeat fingerprinting etc.
• So both DOL-BEC and USCIS Backlog Processing are at the stage of implementing bureaucratic changes, implementing Congressional and Presidential mandates.
• We *are* pressing for transparency and better implementation at both these stages, as well as for 3 year extensions of H-1Bs, EADs and Advance Paroles for those who are stuck in the Green Card process instead of the current one year.

IV. RETROGRESSION HAS BEEN TOTALLY IGNORED BY CONGRESS & THE PRESIDENT
• In contrast to DOL-BEC and USCIS Backlog Processing, Congress has never addressed the issue of Retrogression.
• So the Retrogression problem is a systemic, policy problem.
• It will affect all of us eventually, no matter what stage we are at. And it is only going to get worse, and the delay at this stage is the longest of all. Even if cutoff dates move forward, there is nothing to stop them from moving back again once USCIS starts processing visas faster (see posts on how visa cutoff dates are determined).
• It took a tremendous amount of effort to get Congressional and Presidential mandates to do something about DOL and USCIS backlogs and it will take a tremendous amount of effort to get Congressional action on Retrogression.

In summary, we urge you to get involved with Immigration Voice no matter at what stage of the green card process you are. We are all in the same boat. Immigration Voice is getting your issues heard wherever it goes. We are totally committed to getting the job done - this is not a half-hearted group of people. Look at what we have done in just 40 days.

With Comprehensive Immigration on the anvil and with PACE bringing the issue of American Competitiveness and the need for skilled and qualified immigrants, there can be no better time to highlight our problems. Legislative changes are necessary for us and the only way that can happen is if you get involved.

Status of Labor - God Knows!

A fortnight ago, I asked my lawyer to enquire with the Dallas BEC, and he sent me this screen shot wher Case Source shows as Region and Case Status AS Data under review. Any idea when my 45-day letter could possibly be sent?
State of affairs at home : Desperate :confused:
 
If we don't do anything now, another 50,000 will be in your kind of situation after 2 years. We'll still be watching DOL scr.... us every single day, we'll still be talking screen shots, labor approval from PBEC, DBEC on this forums. It is time now!!! Stand up guys!!!!

We are worrying about PBEC only

I am not discouraging iv.org. It is a good step taken by brave guys. But here we are worrying more about only Philly BEC, not retrogression. But iv.org is concentrating more on retrogression, just adding flavor PBEC. Probably most of iv.org members got 140 approved or labor cleared.

If DOL takes 2 more years to approve these labor certifications, is it possible keep our jobs? The way PBEC is working, noone is confident about whether they clear our labor certificates within 2yrs. PBEC is like hell compare to retrogression.

Let us come out of this hell, we don't care about Retrogression.

It is not only my opinion, many of victims who are struggling with PBEC.

Why not to support the lawsuit against DOL ?
 
Labor backlogs

There is no solution that can be provided by the legislative to clear the backlog, simply because it needs more money to allocate resources and clear backlog.. Lawmakers would not want to allocate money to a program that hires foreign labor when their own market is not doing well.. Money is so scarce even for essential programs.. So IMHO, IV will not be able to make any dramatic changes in the way backlogs could be cleared. IV may be able to make changes in other provisions in the law or have EB quotas increased which are already part of the immigration bills in the congress/senate.

The only option for many of us is to suffer in this quagmire forever. We are only emphasizing a fair process clearing backlog in an equitable fashion.. Lawsuit is the one and only option that I can think of to accomplish this.

I came to US in XX/199X to attend XXXXXX University, where I got a XXXX degree in XXXXXXXXXXXX in XX/200X. Immediately after, I have been working for XXXX Company located in XXXXX of XXXX(your state), until now. The reason I am writing to you is to ask for you attention and support of a comprehensive immigration reform bill introduced by Senator Arlen Specter. In his proposal, people like me, who have earned advanced degree in science and engineering from US institutions and who have worked in related fields for over 3 years, will be exempted from employment based numerical limitation of visa numbers. It also asks for fast handling of labor certification applications in my category.

Although my American Dream started more than XX years ago and I have made many things happen on the dream land of America, one haunting failure in my life is that I cannot obtain a green card. My employer started labor application (the first step for employment-based immigration) in XX/200X, but that application has been put aside for the past more than XX years. During this multi-year wait, there has been a severe retrogression in employment-based immigration visa availability, which means even after I get a labor certification, I still need to wait potentially many years before I can file application for green card. Needless to say, this immigration application backlog has had many adverse influences on my personal life, and my American Dream is barely alive.

Recently I noticed US Senate is taking actions on immigration reform. Several bills, including those introduced by McCain/Kennedy, Cornyn/Kyl, have addressed the issue of employment-based immigration, specifically, taking steps to prevent another backlog caused by visa retrogression. Senator Arlen Specter’s bill, is so far the most thorough approach to address this issue. It also gives those who have been trained and educated in USA, who have spent the most productive years of their lives in America, like me, the best chance to realize American Dream. As a lawful, tax paying resident (albeit without permanent residency) of XXXX(your state) for the past XX years, I urge you, Senator XXXXXXXX, to support Senater Spector’s immigration reform bill.
