That provision is in the Senate bill. I do not know of any such provision in the House bill on immigration (but I could be wrong). The Senate passes a lot of bills that never make it into law. House and Senate will have to negotiate to reconcile their differences. Murthy.com makes this issue perfectly clear. No one knows how long the negotiations will take. Remember that all House members are up for re-election this coming Fall, so it is unclear how willing they are to pass any comprehensive reform bills this year.

Only US citizens can apply for fiance visa. In your case, as a resident you must marry him and then petition for him. You only can petition for him and then wait until his priority date become current and if there is a visa number available then it comes the next step to get the immigrant visa. This entire process is taking around 3-4 years, depending on the country.

Good luck,

You haven't said what your status is in the country. Are you a permanent resident, citizen, or just here on a visa? The answer to that question would vary depending on what your status is. If you are a permanent resident, you can apply for a petition for your fiance after he becomes your husband, but it could take around 5/6 years based on the current waiting times for him to be able to come over. You might be able to become a citizen before that and have him come over much quicker. If you are a citizen, you could apply for a fiance visa and he could come over in 3 or 4 months as long as you want to get married here. Instead, if you are getting married in India, you can apply for a spouse visa and he can come over in about 6 months. Now, if you are here on a visa or if you are a permanent resident, the best option for him to come over ASAP might be for him to find a job here and move here on work or try to move here to go to school or something similar where he will be able to come over on a visa that doesn't depend on you. I hope that helps.

What about V VISA(spouses)

I don,t no wheter its still going on. Earlier Permanent residents can apply for their Husband or wife or unmarried son n daughter for V1 VISA IF THEY HAD WAITED FOR 2YRS. Thats temporary entry visa. You can work like emloyment card. BUT ??????/ i don,t no if its still under law. Plz contact some lawyers. I know it was law till 2002-03 because my friends went on that Visa from Mumbai.
