I am international student with F1 that expires 2009. I got married in November 2006. I filed all my documents for green card in January. However, I was sent a letter from USCIS that i need to prove my husbands income -W2,taxes. He has not filed taxes since 2001 b/c of hurricane katrina and he was not making enough money. We decided to file together for 2006 to show them tax return. He made $9 000 for 2006 and I, as an F1 student, made $7000. My question is if we both file togetehr we will overcome the poverty 125% guideliness for California described in form I-864- Affidavid of support. (16 000). However, I was not sure if my husband is my sponsor and he himself needs to show that he can sponsor me -and show income fro over 16 000 to overcome teh povery line...What is the significance of his income...Can I sent the USCIS only the document prepared from the tax service place and not wait for iRS recept.
