One of my friends is in the Visa process, His wife is a Nurse from India, she has done all the tests, CGNFS, TOFEL, and also taken the RN Exam. She is being sponsored by a hospital. He has mentioned that his wife would get a GC and he would along with her ( are they going to be LPR s). The other question I have is, He is physically Challenged. His considered to be 40 % handicapped. He has the interview at the conuslate next month. Will there be any problems with him medical exam? Is his dissability going to harm his family's possible coming to america and his green card ?

Solid-traveling,

You have been doing some solid questioning in this forum, which is good. I am not aware of his physical challenges and the role they might play in his family's greencard quest. As far I know, USCIS is barred from discriminating against anyone based on physical appearance, which will include this gentleman. I come across people of different physical challenges across the US, and systems are in place to support and offer them a sense of normalcy, but if it weren't for us who constantly stare at them, they wouldn't recognize that they are different.

Thanks Al Southner, i really appreciate the input and the effort the fellow forum members are giving me. Till I started reading the forum, i was totally ignorant about the process. I had appointments to immigration lawyers twice to get simple straight forward questions answerd, paying alot of money. It was regarding my eligibility for naturalization about when i would be eligible. info pass always gave me contradicting answers to my quieries. USCIS customercare gave me even more. The immigration help centre at the nearest community college, immigrations personnal told me that if i am to apply for naturalization, event hough i meet the 5 years residence and 30 months time physically present in america, she stated i might be taken to the immigration judge and deported as they could prove that i am not intending to reside in america. they advised me to file i130 for my wife, let my wife come (in 5-6 years) let her be in america for 5 years as a LPR and get her ciizen ship after filing N400. upon my wife securing hers Citizenship, me apply for naturalization after meeting the 3 years period. and thats 6+5+3 ... 14 years .... who even forsees that i would be alive that long.....

I just mentioned the story to let you guys know how much i appreciate your inputs

Disability is not automatically a barrier to immigration. It depends on whether the disability is likely to make him require long-term care at the government's expense.
