Immigration Custody and Deportation

I know a person he came to USA in 1991 and applied for asylum and his asylum got denied. Someone suggested him that INS will arrest him if go to court date. So, he didn't go to court date and was living in the hiding. Then his wife arrived in USA in 1999 and they applied for another asylum case and didn't mention anything about the old case. Their asylum was granted this time and they were living happily since 2000.

His wife and kids got green cards last year but he didn't. Last week, Immigration arrested him because his name was on the deporation list under the old asylum case. His lawyer told him that Immigration will definitely deport him. He has a house and business on his name and what will happen to it. Can he give power attorney to his wife to sell all his property? Another question is can he still come out on bail for some time atleast for a month or so??:confused:
