The legal tactic is showing some signs of success. The US Citizenship and Immigration Services now asks the FBI to expedite an applicant's background check once a federal suit has been filed, according to a memo circulated last January by the agency and obtained by the Globe.

Now I know what I will be doing if my check is delayed..

Here is another interesting quote:
Some of the immigrants who filed suits, as well as immigration lawyers, said they believed that Middle Easterners and Muslims face more scrutiny and are more likely to face delays than other immigrants seeking citizenship. But federal officials said there's no profiling when it comes to background checks.
 
Foyd - I had thought I am the oldest asylee on this forum - I applied mine on early 1997 too and 1-485 in 2004. Every 4 months I send a letter to nebraska requesting my case be consindered. Another letter is due on January.
Had my Bio code 3 done on December
LUD changed on Dec 16th

I'm the same "age" as you are - applied in March, 1997. Asylum was appvoved in May, 1999. I had my code 3 done on December10, 2005 - just stepped into the office - I had a receipt #, which was corresponding with the EAD application, filed over 5 years ago and was told that there's nothing wrong with that and had my biometrics done, which originally were scheduled on 12/28/05. Hopefully, another step closer to the end of uncertainty. :mad:

Well, we can start a 1997 club :-). Do you get any replies to your letters? If I dont get approval by mid-2007, I will sue.

Yes - I get a reply to all my letters -
The first one went to the Director - Some guy wrote back and ignored my initial complaint that ins sat on my paperwork for a long time - He explained that my case was not recieved till 2004. So after 2 months, I sent the same letter once again and addressed it to USCIS. They responded again explaining the backlog. The letter was signed by a different person. The officer also inserted a notice requesting I notifiy them of my new address if i move. I sent a third letter a month ago -- meanwhile I had recieved my BIO code 3 request and then my
RFE. The computer messages changed to show they have received my RFI.
I'm planning to send the same letter again on Jan 1st.
