Immigrant visa - consular processing

Hello,
I received the packet(mailed to me by the attorney) from the National Visa Center, Portsmouth, NH( in June 2001) to proceed to consular processing ( after I 140 approval) a few months after i had left the company i was working for, through whom the I 140 was filed.As my new employer agreed to take up green card processing, i decided NOT TO pursue the consular processing.

However, my new employer started the immigrant visa application process in October 2001 and recently the labor certification was remanded to state workforce agency, after being with the Federal for more than a year.I do not expect any further further progress.

Question: Can i now proceed to Consular processing, allthough i have left the old company, quite a while back, as my immigrant visa application through the new employer is stuck at Labor?

I may be totally wrong about this. I was under the impression that I-824 should be filed by the company who file the LC & / or I-140 is that true. I have checked various web site but have not foudn this information. If the answer is yes then would this pose a problem if a person who changes a job while on 485 under AC21 and then request AC I-140 via I-824? Would this form be filed by old company or new company? This question is just personal curiosity!
