Hi Guys,

Since we have not seen any new Approvals in the last few days...and life has been boring lately....

I have this question. Now that our I-140 has been approved and that we have applied for I-485, and that we have not yet heard from INS, what is our status in this country?

Immigrant?
Nonimmigrant?

If I am asked that question, neither one is true. I had to fill in one of these forms(Can\'t really remember which one) which gave only above two options. Obviously I ticked the second one. But what are we?

Until you get a stamp on your passport after your 485 approval, you are a non-immigrant. The term \'Adjustment of Status\' itself should be self-explanatory - when it is approved, it means that the INS has approved your request to adjust status from non-immigrant to immigrant - hence you are in non-immigrant status till it is approved.
