Immig gurus - 485 approval when outside country

sr485

Registered Users (C)
Hi,

My H1-B expired and I want to go out of country.
I have valid EAD & AP.

I am expecting 485 approval anytime soon(CSC RD June 21)

Will it be a problem when re-entering if the 485 is Approved while I am out of USA.

Thanks

New INS memo makes parole back in more difficult, may not apply here though

Another common situation, not specifically mentioned in the INS memo but previously authorized in INS instructions, is if the I-485 application is approved after the applicant\'s departure from the U.S. In that circumstance, it is typical to grant deferred inspection, so that the person can go to the local INS office and obtain the permanent residency stamp in the passport.

There should not be any problem.....

However, I have read postings that at the Port of Entry the Immig officer may ask you to get your passport stamped at INS ASAP, and then report back to him at the airport.
