Guys ... I am doing it NOW - AC21

Enough of My Desi employer's Cage @ 7.50 / hour for 12 hours a day / 5 days a week / 6am - 6pm / not a single day 15 mins late.

My story is ;
* LC Substitution, Concurrent filling I-140, I485, I-765, July 2001.
* I-140 approved Oct 2001.
* EAD Nov 2001.
* Over 210 days of RD/ND + Letting him eat my brains.

My wife is working on EAD and has a GREAT job, living her life, and I wanna do the same too :D

So I have decided to leave this Company A even without getting the " Simillar " Job. Though I am working on it with the help of my Friends will get " all necessary " papers to prove I have a " SAME " job, with periodic Paychecks and Paystubs. I am very Positive to find someone who wud do me a favour and save TAX on atleast 60K.

YES , I am taking the RISK

My concern is When Should I inform BCIS ?

1, At the time when I leave Company A, OR
2, At the time when I JOIN Company B

What if I dont get a "simillar" job for say 3 months ?

Interesting question haan ?

Do not give any information to employer before you get all the details like approval notices. If you don not have I-485 receipt get it first. Get ETA-750 A and B. You need it for job description and salary.

Most important is If your attorney is company paid Please be sure that he will co-operate with you. If not change attorney. Get all the papers through new attorney.

Do not worry. Market is picking up you will get better job.

Even I swithed the Job. My company attorney was good. So i hired him only. It helped me lot.

sounds like you have assessed the risks and made up your mind. Good for you - how long can one be a slave because of INS incompetence ?

As far as I understand - you are not legally obligated to inform BCIS of a job change, but it is encouraged.

1) After 180 days of I-485, the ex-employer *may* attempt to revoke the I-140, if that happens BCIS is supposed to send you a NOID. You have 30 days to reply with the requisite paperwork, and once you do and establish eligibility under AC21, you will be fine.

2) You can choose to avoid any future BCIS screwups by informing BCIS of the new job (I believe after joining the new company) and establish eligibility under AC21. This might even avoid a random employement RFE due to "quality control"

3) You don't inform BCIS and no RFEs are generated and you get approved without BCIS even knowing of your job change.


So the worst case scenario is #1 and the best case is #3

I am trying to talk to a friend who runs a company and might be in a position to hire me " on papers " atleast.

In that case , I wud inform BCIS to avoid the NOID ;)
