For anyone out there that remembers me, you will know that we did not get our GC's in October like we hoped, so unfortunately we have had to forget about our loss, and start the process all over again. Our eldest daughter (my step-daughter) who recently got her citizenship will be the one filing for us, (we were married when she was 6yrs old). Hopefully this time all will go well.

Timeline

12/16/09 - Posted I 130, I 485 & I 765

Em, first of all, can ur step daughter file for u, since she isnt ur biological daughter? or maybe u have adopted her?

also is ur step daughter over 18?

good luck!

I read somewhere that a US citizen stepchild may file for a step parent if the marriage took place before the child's 18th birthday. In this case I think it is ok since the child was 6 years old when the marriage took place.

I'm hoping what DADDY09 said is true, actually thats why I noted that we have been married since she was 6yrs. I do know that they will request a DNA test because her mother did not put her fathers name on the birth certificate (out of spite I'm sure) and the child always carried the mothers name, but other than that we are hoping that all will go smoothly. Also we have still used my sister as a co-sponsor to cover the amount of money requested as she (stepdaughter) has a family of her own as well as is attending college. Will update as we go along, I do know that they posted the I 130 notice of action form to her but I guess we still have to wait on the approved ones.

We are not sure if we will still have to go take fingerprints again as we did them about 6 mths ago or if they will simply post the new work permits to our home as we already have valid socials.

Any advice will be appreciated.
