Hi. Im a former Au Pair. I came to US with a J-1 Visa in 2007, this visa expired in 2008 but I got an extension in 2009. However I lost my legal status cause I left the program. In 2010 I married a USC being in an illegal status. I want to know if I have to pay a fee for staying illegaly in the couNtry and which applications I have to file to fix my status. Thanks

Is your J-1 subject to the 2-year home country residence requirement?

If not, you don't need to do anything different* than most other applicants who are applying based on marriage to a USC. For the documents you need to file, see post 4 of this other thread: http://forums.immigration.com/showt...een-Card-Do-it-Yourself&p=1975217#post1975217 and download and read the instructions for each of the forms from USCIS. There is no extra fee for staying illegally, because you entered legally and are married to a USC.

If you have more questions after reading that thread and the instructions for the forms, start a thread in the Family Based Green Cards section: http://forums.immigration.com/forum...ed-Green-Cards-Through-Marriage-or-a-Relative

*except that you should not apply for Advance Parole (I-131) as it will be useless even if approved, due to your overstay
