If you do not join on H1, does yr status remains the old one.

Hello All,

I have a similar question as the one asked and answered in the email below.
Actually i am in F1 status doing PhD. Have valid signed I20. Applied for an H1 but due to some reasons do not want to join the firm that filed for it.
I am just wondering if i do not join the firm i got H1 from, then does my status
remains F1. As in the below given case, my application has asked for a status change.

Pls pls advice.

----yes, becase you have I-94 attched with H1 approval notice , lower right side, detach it it and staple it in your Passport9 make the copy of I-94 front and back and copy of H1 approval for your future records and keep it in your immigration file)
I am currently in US and have not yet got my H1 stamped. So currently am I on H1?

And is my previous visa ( f2) cancled?
---- you are no more on f2 status and Visa stamp also invalid your employer may have filed f2 to H1 CHANGE of status, if you want to go out and again want to enter US you will have to get H1visa stamped in your passport to be back to US

if your h1 transfer approved along with change of status (if you got i94 attached with the approval notice) then you are in h1 and NOT in F1.

in that case you are supposed to start working (from the effective date on h1 approval notice) and GET paid without any break.
