If Visa Denied...Please Respond

I have been waiting for my fiancee to get his H1B visa stamp. We have been waiting for about 4 months now (since his interview in Pakistan) with no repsonse from the embassy. Our plan was to get married here in the States after he came back, but now given the amount of time it has taken, we have started to think about other scenarios because we simply have to. I was wondering what happens in the case of a visa denial (knock on wood this will not happen). Meaning if he was denied after this wait time would this mean he could never re-enter the US? What are my rights as a US citizen? If we are married will he be allowed to re-enter?

Please, please someone respond.

Waiting Ever-so Patiently :(

Unless there is a computer "hit" he should get the H-1B visa . His employer ( if has one ) can call the Embassy.
Generally H-1B visa is not denied unless the degree is fake or the job itself is fake.
Howeevr if everything else fails and if he could not get H-1B visa, you as a US citizen can file for his fiancee visa which may take some time at least 2 months and but you will have to prove that you have met ( picture together etc).
Better yet you should consult some attorney.
Note : This is not a legal advice.

Thank you!

Hello Ashikaul,

Thank you very much for your response. As for his information it is all completely legitmate - nothing fake here. I didnt realize that his company could actually call the embassy; however, so I will inform him of this. We are going to be contacting his attorney to see if she can give us any additional advice as well. It is indeed a tough situation because it calls for much patience. We are honestly trying to have as much tolerance as we can. I just had begun to get worried as it IS taking SO long. In any case I do appreciate your email. Out of curiosity had you been through this process for H1B?

Thanks much again - you have given me some hope.

yes i have been through the h-1b process but long time back and that time ( in India) it was a breeze.
Anyway, good luck
