If new visa gets rejected can i still come back to usa with existing visa

Hi ..My visa is valid till 27-nov-2004 and have got my visa extension,
According to the new law to get visa stamped we need to leave the country and
come back, we plan to leave to canada in August and get visa stamping for the new h1....
but the question is, If in case our visa gets rejected while we are in canada
can we still enter USA with the existing visa ( which is valid till 27 nov-2004)

why do u want to apply for new visa when ur current is valid till nov 2004. Just travel before ur visa expires and come back OR if u have to travel after it expires then take app in advance.

As for ur question, I dont think u can come back because they will stamp ur PP with application received 221(g) and they may cancel ur previous Visa.

So I would suggest not to apply for new visa until ur current expires.
 
stamping in canada

I am also in same boat... I have valid visa stamping till Oct 2004.
and a valid I797 till OCT 2005.

Not able to decide ... should I take the risk of going to canada....? just get along with valid I-797 approval / new I 94 ???


My another question is while applying for I140/485 do we need a valid H1B stamping in passport?
