Do you automatically get approval if the I-485 has been pending more than 540 days? For this question, I am assuming nothing changes in the status quo (i.e., no change of address, no quitting from work, no new immigration laws, ...)
I applied for the I-485 in August 2000. My ND is Sept 20, 2000. I called INS and they told me that the I-140 actual approval letter is missing and that this is an internal issue that needs to be addressed by INS only and I can do nothing about it. The IIO also told me that I have no problems and should wait 45 days to get the I-140 actual approval letter from another office. I think after 45 my application will not be processed. Does waiting the max # of days (540 days) guarantee the GC?.
P.S. The 540 days is the max number of days for the I-485 processing by VSC.
Thank You
