Iam on H1 B and my 6 year term gets expired in july 2005. I already filed for my labor 3 months back and i understand if my labor is still under processing i can keep extending my H1 by every one year. But lets say i did not get response till july 2005 and i applied for 7th year extension and it has been approved. If iam holding H1B approval till july 2006 and in november 2005 my labor gets rejected am i out of status immediately or since i got h1 approval till july 2006 can i stay and work until July 2006.
Please anyone of you let me know. Your help is highly appreciated

Actually Ray, I am not sure that the new labor application would have to be pending for at least a year (I am not sure though). I believe the language of the law refers to "Any" labor certification application that has been filed at least one year ago, so he could potentially argue that since the original labor was filed more than a year ago, that is sufficient to warrant further extension of the H.

I am not a lawyer - this is not legal advice - just an opinion.
