Hi, Everybody:
I filed NIW application to Nebraska Processing Center in May 2001 and got a notice in August. I talked to a representative over the phone recently. Answer was: still pending. I am so confused because the I-140 processing time was October based on time table posted on November 30. If anybody knows what is going on about this, could you post out??? Thank you.

Similay withyou. I filed EA in early July. No word until 12/12.
I called IIO repeatedly (5 times at least) betwwen Oct to 12/12---same answer, pending.
Then on 12/12, got lucky for nice IIO, she carefully checked the database, and found the case was decided on 10/9!!! but INS had not mailed me anything or update AVM until I spoke to this IIO. then just few days ago, I got the mail--it\'s RFE. But only 2 weeks deadline to response due to the delay INS sent the letter: the letter dated 10/9.

So your case may have some decision yet, but INS has not sent you or update AVM. SO try to speak IIO, if you are lucky, you may get a real answer.

Try to talk to IIO

I guess your case has not gone smoothly. It may be a case like ycheng. Check with IIO frequrently; check AVM and your mail frequently. Hope you can get somenew information soon.
 
IIO answers!!

I have applied in May 2001. ND: Aug 2001. RFE in SEP, Reply in Oct.
One IIO: call after a week, another IIO(called after three weeks): with an officer, one more IIO (called after two weeks): a letter is sent, when asked "is it a denial?" answer "looks so...".
It is more than 10 days (since the denial answer), no letter, no AVM update...

If IIO says "a letter is sent", it is not a good sign. You should get prepared. Try to see if there is some other catagory you can apply while you are waiting... It is hard for you to be sucessful to apply the same catagory GC within a short time...

My NIW appeal has been pending at CSC for 20 months. Do not count on appeal. Try EB1 if you have a PhD. Good luck.
